Terms of Service

1. Who we are

These terms are an agreement between you and Megative PL sp. z o.o., ul. Odrodzenia 27/4, 59-140 Chocianów, Poland, KRS 0000954355, NIP 8943181491 ("Kolega", "we"). Contact: hey@heykolega.com.

2. The service

Kolega sells data-only eSIM plans. A plan gives mobile data in the destinations listed for that plan, for a fixed amount of data and a fixed number of days.

Personal and Business Data plans do not include a phone number, voice calls or SMS. Apps that use data, such as WhatsApp, work over the data connection with your existing account.

We connect you through partner mobile networks. Speed, coverage and network availability depend on those networks, your device and your location and are not guaranteed.

3. Account and eligibility

You need an account to buy. You must be at least 18, or have permission from a parent or guardian, and give accurate details.

Keep your login safe. You are responsible for activity on your account.

4. Device compatibility

You must check that your device supports eSIM and is not network-locked before buying. An eSIM that cannot be installed because the device is incompatible or locked is not a fault of the service.

5. Prices and payment

Prices are shown in euro and include VAT where applicable. The price at checkout is the price you pay.

Payment is taken by our payment provider when you place the order. We do not store your full card details.

6. Delivery and activation

After payment your eSIM QR code and install details are shown in My eSIMs, usually within minutes.

Validity starts as described for the plan, normally when the eSIM first connects to a supported network in the destination. Unused data expires at the end of the validity period.

Each QR code can be installed once, on one device. Deleting the eSIM from your device may make it impossible to reinstall.

7. Right of withdrawal and refunds

See our Refund & Cancellation Policy and Right of Withdrawal page. In short: you may cancel within 14 days if the eSIM has not been installed or activated.

8. Fair and acceptable use

You must follow our Acceptable Use and Fair Use policies. We may suspend a plan that is used unlawfully, resold without permission, or used in a way that harms the networks.

9. Liability

Nothing in these terms limits liability that cannot be limited by law, including your statutory rights as a consumer.

Otherwise, our total liability for a plan is limited to the price you paid for it. We are not liable for indirect losses or for outages of partner networks outside our control.

10. Complaints and disputes

See our Complaints page. Consumers in the EU may also use their national consumer bodies. These terms are governed by Polish law, without removing the protection of the law of the country where you live as a consumer.

11. Changes

We may update these terms. The version in force when you bought a plan applies to that plan.
